These Terms govern your access to and use of gymandequipment.co.uk and any orders placed with Gym & Equipment. By using the site, you agree to these Terms.

1) Using our site

  • You must be at least the age of majority in your jurisdiction, or have consent from a parent/guardian.

  • Do not misuse the site (e.g., introduce malware, attempt unauthorised access, or infringe others’ rights). We may suspend or terminate access where misuse is suspected.

2) Products, pricing and availability

  • We work to keep product information current, but occasional inaccuracies or stock discrepancies may occur. We may correct errors, update information or cancel orders that cannot be fulfilled (a full refund will be provided where payment has been taken).

  • Images are for illustration. Colours/finishes can vary by screen and production batch.

  • Prices and promotions can change at any time. VAT, where applicable, is shown at checkout.

3) Orders and payment

  • An order is accepted when we send a dispatch confirmation. If we cannot accept an order (e.g., security check, pricing error, no stock), we’ll cancel and refund any payment taken.

  • You agree to provide accurate billing/delivery details and keep them up to date.

  • We may refuse or limit quantities per customer to protect fair access and prevent abuse.

4) Delivery

  • Delivery options, timeframes and costs are set out in our Shipping Policy. Timeframes are estimates and exclude events beyond our control. Risk in goods passes on delivery.

  • Please inspect deliveries and report transport damage promptly.

5) Returns & cancellations

  • Your statutory rights are summarised in our Returns & Refunds Policy. Please read it before initiating a return. Some items are not eligible for change‑of‑mind returns.

6) Third‑party links & tools

We may link to third‑party sites or provide optional tools. These are offered “as is” without endorsements; use them at your discretion and review their terms.

7) Intellectual property

All content on the site (brand names, text, graphics, photography, code) is owned by or licensed to us. You may not copy, reproduce, or exploit it without permission.

8) Limitation of liability

Nothing in these Terms limits liability that cannot be limited under law (including for death or personal injury caused by negligence, or for fraud).
Subject to that, we are not liable for:

  • losses not caused by our breach;

  • business losses (including loss of profit, revenue, contracts or goodwill) where you purchase as a consumer;

  • delays or failures caused by events outside our reasonable control.

9) Indemnity

You agree to indemnify us against claims arising from your breach of these Terms or your violation of law or third‑party rights.

10) Severance

If any part of these Terms is found unlawful or unenforceable, the remaining sections continue in effect.

11) Changes to these Terms

We may update these Terms from time to time by posting a new version on the website. Continued use of the site following changes constitutes acceptance.

12) Governing law

These Terms are governed by the laws of England and Wales, and disputes are subject to the jurisdiction of the English courts.
